following few more reasons may be added.
- When a new employee arrives his/her knowledge of immigration matters is quite less and doesn't intend to take risks of going against the employers wishes. This is being exploited by many employers by way of threatening to cancel H1, intimidating that they will have to return back, instilling fear in all ways and means in the employees about the negative aspects. This leads the employee to think and step back in going against the employer.
Soln : Better educate the new employee about his rights as soon as he arrives. This could be either through forums, websites or even an official supplement from USCIS which should be handed over to the employee when his H1 is approved. ( It could mention and clear all myths officially by USCIS). This instills courage in the employee to question the employer if not go ahead with law suits. Also, this even may reduce threatening by the employer.
- Further most of the employees want their career slate to be clean without any law suit, dots, etc until their life is secured by way of GC approvals or some form of assurance from the Govt. This makes them step back on taking action against the employer.
Soln: Well if there could be a system where anonymous complaints/whistle blowers are allowed, they probably may come out. However, rarely employee wants to reveal his identity though he suffers.
- The immigration matters are so complicated with so many RFE's people are scared to add another their event to their history. Any transaction with USCIS is kind of a risky feel for the employee.
Soln: This feeling should be removed.
- immigration decisions are uncertain so people want to be cautious in taking bold steps.
Soln : There should be assurance from USCIS that provided everything on the candidates side is good that his GC will be approved. Folks,
I am speaking in my personal capacity here. While I am all for freedom of expression and assembly, I don't think that rallies will in any way help our cause. We have to talk to people and participate in various forums to make them aware of our cause. Standing and protesting is not going to help us, because our voice will still be lost in the din...we need to speak where it matters and be heard where it matters...

Buying a house is a risky proposition on H1 specially considering the fact that if one is laid-off and needs to relocate within a short-time then one may end up loosing money. Besides getting into the hasseles of home maintainence is trouble-some and expensive and probably not worth the time and effort if one is uncertain about their future in this country.
Having said that if an individual is good at taking calculated risks and has a secure job then rewards are truly exceptional. I would rather wait atleast till the time of filling I-485 before making any long-term investments in this country. I know lot of my friends are probably going to do the same.

2) Filed for I-140 . Cannot file 485 now.
3) H1B 9th year going on.
One good thing I did ,I bought a house in Dec 2002.Now If I sell the same house,I will get minimum 100K profit. I will get good appreciation now.I recommend you guys to buy a house now. It is the best time to buy a house,because it is "Buyers market" now ! You can make some money if you sell it later...

Thanks man!!!, for bringing me in to reality. I thought I can hope and live in dreams atleast for couple of weeks. You are not allowing me do that. You always want me in the reality and be sad that I could not file and angry that USCIS messed it up.

Could anyone recommend medical insurance for parents over 80?
Unfortunately you are in with little luck for parents over 80. In most American Travel insurance quotes you will see that for 70+ the maximum coverage is $100K and then for 80+ it is just $15K. This is total sham - the purpose of all insurance companies is just this - make the most money by insuring themselves against risk, even at the cost of insurer.
My suggestion to all of you would be to go for comprehensive coverage with a good network. I found http://www.nriol.com/insurance/insurance-worldmed-long-term.asp this site to be useful - don't mean to advertise.

Like I said, I did not catch the whole speech, but from what I heard, he was not talking completely against it, he mentioned that businesses need more H1B's and should be able to hire foreign talent.
He was mainly against abuse by big consulting firms (he gave out a statistic that 20K of the H1B went for 8 or 9 of the top consulting firms or something like that).

Do not tear the GC, instead if you ever receive it and decide going back to India, frame it. One may never in his or her lifetime wait for an entity so much desperately as we all have for the GC.

My fear came true today. USCIS issued a RFE for my wife's I-485 TB test and she is in India right now. RFE has May 6th deadline and she would be back on June 3rd.
What are our options?
Request an extension for RFE?
Pre-pone her trip? (this would be really a costly option for us...since we have so much planned around that date)
Do TB test in USCIS approved surgeons in india (If there is any)

Please check the website of the US consulate of the particular region of India where you reside, like delhi or chennai etc, and or call their information line. They would have local hospitals or Medical examination certification centers that are designated by the consulates as being eligible for providing medical certificates, especially for people with Consular Processing interviews. I guess, that could probably help. Consult your lawyer or take an infopass to verify this information accuracy. Thanks. Sree
